    Hi Guys,

    I'm not sure if this is the correct place to post this, I'd presume it's either here or the legal forum (Can a Mod move if I've guessed the wrong forum?)

    I'm currently undertaking a thesis on How Ethical is Marketing via the Mobile Phone?

    What I am searching for at the moment is; In Ireland, is there any legislation in place to govern mobile marketing?

    If so, does anybody know the name of it, and/or where I could find some more information on it.

    What I've found at the moment is the revised manual of advertising self regulation with the code of standards for advertising, promotional and direct marketing in Ireland (6th Edition) 2007 located here: http://www.asai.ie/code.asp


    Any information would be much appreciated.

    Hi Looder,

    I would suggest having a look at the Data Protection legislation around this area Statutory instrument 535 commonly known as the ePrivacy Regulations provide a number of rules that must ber complied with including the requirement to have consent and providing a means of opting out from the marketing in the first place.

    You should also take a look at RegTel's code of Practice which applies certain rules to Premium rate SMS messages. http://www.regtel.ie/cop_choice.htm
