Short term contracts question

    Hi folks my gf has been working since last november (08) for a well known shop. She was signed as christams staff last november and given a temporary contract, she only works part time as she is in college. She was told when her contract was up she would be kept on. In november when she should of have got a permanent contract she was told they would only be extending her contract till christmas and she would be notified on christmas eve if she is being kept on.

    So my questions are

    1. After working there continously for a year is she not entitled to a permanent contract

    2. She has been workin a lot in the run up to christmas, wat are there most number of days a person is allowed to work consecutively?

    No. She's been on a fixed-term contract that was extended. This is quite different to a permanent contract for which probation ends after one year.

    If she manages to clock up four years of temp contact extensions, then she's entitled to a "contract of indefinite duration".

    Her average weekly hours cannot exceed 48 hours. This average is calculated over a four month period, so effectively in the period of September to December 2009 (18 week period), she cannot work more than a total of 864 hours (18*48).

    There is no provision or alternative maximum hours for part time workers.

    The only other legislation in this case that must be complied with is for minimum rest periods:
    • 11 consecutive hours rest in a 24-hour period; and
    • 24 hours consecutive rest in a 7-day period or two 24 hour consecutive rest periods in a 14-day period.
