Drinking in public with your hooch in a paper bag , legal?

Is it illegal to drink alcohol in public even if it's in a paper bag like those pesky Americans? I was of the understanding that it was illegal to search you therefore they can't actually be sure it's alcohol. Is this the same in Ireland?

Where a Garda has reasonable cause to suspect that an offence under Sections 4 (intoxication in public place); 5 (disorderly conduct in a public place) or 6 (threatening, abusive or insulting behaviour in a public place) has occurred, he may seize any bottle or container which is in the possession of the suspect and which the Garda suspects contains an intoxicating substance, where that substance is revelant to the offence. Some local authorities also have bye laws covering drinking in public.
