My landlord agreed verbaly to pay gas and electricity so the billing name was left in his name, we are moving out of the house in a few days. He is saying we have to pay all the bills up to date before we move out. we never signed any lease agreement. do we legally have to pay the bills if they are still in the landlords name?

    Are you PRTB registered?

You would have gotten a letter about it and the Landlord would have had to sort it out at the start of the tenancy.

If not then i would use that as bargining chip aganist the landlord since they are not legit.

No lease probably means no rent book either a host of other things the landlord hasnt done properly. You could just ask them for the PPSN number so you can claim your tax back aganist your rent. Watch their reaction and see if they change their mind.

Legally i've no idea. Contact threshold http://www.threshold.ie/

Um, if you are living in the house you pay the bills right up until the day you leave. Thats only fair. You are still using utilities, doesn't matter if they are in landlords name.

If you don't pay them he would be entitled to deduct from your deposit so no point in being a smart ass just because the bill isn't in your name.

The landlord according to the OP is renaging on an agreement that the rent included the bills.

    dont think so
    verbal will not count
has to be in writing, with signatures

Verbal can count, if you can prove it, for example a witness, if this case the fact that the bill remained in the landlords name might back up the OP's case.

    in that case yes,
also how much he/she would be paying weekly would be a telling factor, and how much rent is paid in that area in general would help

If the bill is not in your name no one can come after you so why pay if the landlord had agreed to pay the utilites up to now?

Which is more? The deposit, or the bill? Also, do you think he's hoping you do run, so that he can keep your deposit without a fight?

While coming across yet another ass of a landlord, I found my self perusing the threshold website. To see that they are looking for support for this campaign.

"Similar reforms have been implemented in Australia, New Zealand and the UK and this has greatly reduced the number of times tenants unfairly lose their deposits. Tenants in Ireland are placed in danger of homelessness when a landlord unfairly withholds their deposit."

agreed verbaly First mistake - always get things in writing, it saves so much hassle.

to pay gas and electricity - was the agreement that he would pay the bills however much you used (i.e. the rent was all inclusive) OR that he would pay the bills when you had paid him?
