house insurance problem!

    In 2007 I used my house insurance to claim for a damaged Laptop and received 399 euro for to replaced damaged .

    In 2009 (may) I had a small leak in an upstairs bathroom, which wet a downstairs ceiling, and I rang my insurance as i wasnt sure how extensive the damage was! (As it turned out the damage was minimal and I never bothered to claim anything from the insurance company .. as a friend fixed it for me.)

    Last month (may 2010) , We had a 'water escape' which damaged a timber floor downstairs in our house.
    I rang our new home insurance company, which we had changed to early this year . They had somebody out to inspect the damage , and he agreed a settlement figure. A couple of days later, I received a call from insurance company to say that we had 'not disclosed a pending claim', and they were terminating our policy and not processing our claim for damage!
    (apparently the claim in may 2009 was not considered closed even though we never bothered to claim a penny for it and this was non disclosure as we never realised it was important to mention it as we never pursued any compensation for damage)

    Now we are struggling to get house insurance and have none at present... What do we do?
    Is there any companies who quote for people in this situation or is it worth appealing the insurance companies' decision.

    Appeal. Insurance ombunsman. You acted (presumably) in good faith.

    You did what you are obliged to do in 2009, advise your insurers ASAP of an incident that might give rise to a claim. It might have been better if you eventually told them that you were not persuing it, but as long as you have not been active in going ahead (sending in estimates, claim forms etc) I don't see how they can take that action.

    Most insurers close a property claim themselves, if nothing is heard within 6 months, so there is an issue on their side too. Ask to speak to a supervisor, explain the points I raised above and if you don't get satisfaction, contact the Ombudsman

    The procedure is, you download a complaints form on the ombudsmans website, and you fill it in and post it to them.
    They contact you back then.

    Thankfully, the ombudsman got back and told us to formally present our case in writing to the insurance company......
    They (insurance co.)have told us that they will re-instate our insurance policy if we pay arrears which would have accrued since they cancelled it, that the situation was dealt with completely wrong! So at least the cancellation no longer exists.
    Regarding the claim, they said to re-present the case once we have been reinstated ...
    If we had let them, they would have ruined our insurance status for 5 years!
    Thanks to the ombudsman we have managed to save our status!
