    depending on when these changes were "announced", you could be in an awesome position by the sounds of it

    if this new info was already available when you signed, you may have agreed to the changes

    If your want to get out of your contract you won't be getting an upgrade, you'd get a new phone from which ever network you move to.
    If you want to stay with o2 and get your upgrade your in the wrong thread.

    I think alot of people would be in my position and confused about the situation so I think it was a proper question to ask.

    I have a iPhone 3G and am due an upgrade. I intend getting the iPhone 4 with O2, therefore I'm better sticking with my contract and renewing when I get my iPhone 4 for cheaper with my upgrade.

    My only decision is whether I want to come out of contract, go up North buy an iPhone 4 sim free before release date in the republic and get onto a cheaper monthly sim-only tariff.

    the iphone contracts were all for 18 months, so not entitled to an upgrade until then apparently

    Just called this morning.
    Was told I'd be released from my contract, but would have to port off the network within 30 days. Told them others online have been allowed stay on, at which point they said they'd refer it to the team dealing with this issue, and I'd get a call back.
    Tbh, I can't see how they can make you leave...surely that isn't releasing you "without penalty" as stated?

    Just had it confirmed by the mods on the O2 Forum that I am out of my contract, seems if you called early enough yesterday they just took you off with no questions.

    Have requested an email from them as well but the Mod comment will do just fine :D

    Yes. They should unlock the phone for you if they dont then thats a penalty and the regulations state no penalty. Just be nice but firm with them

    let us know how you get on - my OH is getting the same run around at the moment but I was released from my contract yesterday with no hassle and can continue as an uncontracted O2 customer

    Is there normally a big price difference between getting an iPhone on upgrade compared to a new contract?

    I got out fine yesterday, my sister had some difficulty on the phone but told her to quote artilce 17, once she did that no problems.

    My brother tried to do it yesterday evening and he had to make 3 calls. He kept calling me saying they would not change it for him but whne I told him to quote Article 17 ......Hey preasto...Out of his contract.

    Must say though 02 are getting some bad press on this forum.

    Dont get me wrong I am delighted to be out of my contract 14 months early, but 02 IMHO are a good company with excellent customer service. Have always been a pleasure to deal with. I have been with them for 8 years bar one year I went to Vodafone (was not that please with them). I have no real intentions of jumping to Vodafone.

    Agreed, I've always thought their customer service was good....apart from those annoying "just ringing you to see how your current plan is suiting you" calls.
    It just suits me to be out of contract now as the wife wants an iPhone4 and we can go to whichever network has the best deal for her without any problems.
    No problem if thats with O2.

    If she won't send an email go on to the O2 Forum and ask the mods there to confirm that you are contract free and can cancel at any time with 30 days notice, you will get it in writing there !

    Will 02 deal with me if I try to cancel via email?

    They might although you may be giving them an opt out. I can see it now.

    "Due to the large number of emails we are currently receiving it will be a while before we get back to you say the 13th of July!!!"

    In a moment of madness a few weeks ago, I went from clear sim to an 18 month contract for a HTC Desire.

    Didn't like the Desire so sold it and went back to my iPhone. And now you've allowed me to get out of that damned contract!

    Just had the same experience, though she didn't put me on hold. Called me back within 2 minutes. Excellent service once I got speaking to the team dealing with the issue.

    I'm waiting on the call back from them, she was telling me I'd have to leave o2, told her I wasn't having that. In fairness to her she claimed she is acting as directed by her supervisor, she said one of the team will ring me later. I also emailed them last night.

    Just got released there no bothers at all...they were extremely mannerly etc

    But they would not release my parents contracts who were on the 02 release edge package

    How do I fight their corner? I said I wasnt happy with the 11811 thing and they said that wasnt nothing to do with it etc?!? They said they would ring me back

    I gotta commend O2 on this. If anything, it makes me likely to stick with them.

    I deal with Vodafone in work and have been with O2 personally for years and I would always rate O2 higher on customer service.

    And given 90% of my family and friends are on o2, it's still cheaper overall to be with them.

    You wouldn't be of that view if two of their 1909 customer service folks were telling you you can only opt out of your contract if porting to another network. If anything they are pushing me to f off.

    So Rang up. Got the script that the iphone was expensive and the contract covered this expense not just the phone tarrifs. States Reg 17, then the tune changed and they said i had to leave the network. I said that was a penalty, the changed tune. so i can stay on the network now. they offer new contracts and price plans. etc.

    end results is out of contract 10 months early and unlock code on the way. Great customer service. but savage prices for the plan so i can now look around.

    I'm just speaking from my own experience. Sorry to hear you're being messed around. You are entitled to be released from your contract without penalty so stand your ground and demand your rights

    It is a means to get off contract, who wants to be contracted these days ? I'm a self employed contractor, I could either be out of work or working abroad at the drop of a hat so I would prefer not to be under contract with 02.

    ? O2 are making changes to the terms of your contract.

    It is your right to cancel the contract if you do not accept these changes.

    If another plan with o2 suits you better, then why change networks for the sake of it?

    So at this stage I have rang up 3 times. 1st time was a total nightmare very rude operator. 2nd & 3rd time very nice but regardless of what I say they said I have to leave the network. So I requested an unlock code and I will be dropping into vodafone getting a prepay sim for free and biding my time until Iphone 4 comes out. I can't understand O2, they are really shooting themselves in the foot.

    I think it's because of the fact that as they are changing the terms and conditions of your current contract they need you're agreement. If you dont agree to the terms you can be removed from contract but it doesn't force you off the network. It is then your decision to leave when ever you feel you want to or whenever you feel there's a better deal. I know it sounds strange but it is correct. If they forced you off the network that would be a penalty (which is not permitted under the act). The funny thing is that it's to do with the "small print" which normally screws the customer over but this time it's messing with the networks heads. The same applies to all the networks. I'm sure people on all networks will be looking very closely at changes to their T&C

    The very minor change they made to their pricing does not affect me in any way, shape or form but, it has allowed me to demand to be released from my existing 18 month contract. Why wouldn't I take advantage of that??? It's always better to be a free agent rather than constricted by contractual terms.

    Did you quote regulation 17? And did you say you've got friends who did the exact same thing this morning?

    Once I mentioned reg 17 (and quoted it), told them I did not accept the amended terms and conditions and wanted to terminate the contract in no uncertain terms, they complied.

    And had no problem with me changing to o2 clear sim.
