    Hey There,

    I am just coming up to finishing my paid part of maternity leave. My employer very kindly topped up the maternity benefit so that i had full pay while i was off. There was a clause that it is repayable if i do not return to work for them for the period of a year. Which was fine i was going to be returning to work anyway, until my husband lost his during the past month. He has since found a new job, the only problem is it is in England, so i wont be returning to work, as we are going to move over (my husband has the larger salary). I am just wondering if anyone has been in a situation where they had the employer maternity top up and how they faired out trying to work something out repayment wise with their employer if they decided not to return to work or couldn't return to work as with my own situation. Or did the employer enforce the repayment clause.

    This is not a case of not wanting to return to work and still wanting to be paid for the privilege, like i said i was fully expecting to return and wanted to return to work after my maternity was up, unfortunate it's not going to happen due to unforeseen circumstances......any insights would be appreciated.....

    Why not talk to your employer and explain your situation. Don't agree to anything, just have an informal conversation. Then you can plan the next step.

    I'd also bring contract and terms of employment to specialist to ensure it is all legal. I would also keep in mind that you may be looking for a reference from this employer at a future date and it might be best to consider some sort of amicable resolution to the situation but as stated above have the informal chat.
