    I'm not unhappy to see the government given a rap on the knuckles - using their majority to repeatedly block any attempt to fill the vacant seats was quite possibly the most cynical ploy by this government to date - but I still reckon there's a SoP issue here, and that we really need a constitutional amendment to force a time limit on by-elections.

    They're holding the bye election and appealing to the Supreme court.

    What a way to waste tax payers money.

    Heard Pearse Doherty on Newstalk earlier, he said the only reason FF are appealing is to stop SF taking them to court to call the other 3 bye elections. Apparently, once they lodged their appeal, SF can't take another action.

    And 18% of the population would STILL vote for them in a General Election. Am I the only person who is disheartened by that? 18% (and they would probably get closer to 22%) could be enough to see them in government as a minority partner.:eek::eek::eek::eek::eek:

    a national list?? and what if it emerges that everyone elected is from munster or cavan?? what happens to the rest of the country?

    You really should not believe everything SF say. It is important that the government appeal to clarify the Separation of Powers issue and it is a side effect that the other actions cannot currently be taken. Legally,it's actually irrelevant. The governments move to call the bye election today is a political decision. Nothing in yesterdays judgement forced them to do so

    I believe the high court have acted incorrectly here and I think the SC will reverse the declaration. I also think that following the SC ruling the government of the day should move a referendum to put in place a time limit for future bye elections.

    This so called Government is not interested in clarification but purely to delay any future bye- elections if it gets a long protracted legal case or a favourable ruling.

    Oh I know that, I am intrested in clarification however, hence I, for my own reasons, think this appeal is a good thing.

    It is a good thing indeed.
    FF know anyway that FG or Labour intend or promise to bring in electoral changes anyway in regards to this so its somewhat a mute miserable excuse by FF anyway.

    Why someone from the same party ?

    Just because the "dead" candidate might (possibly) be the best and have gotten themselves elected doesn't mean that the same party had a decent second candidate that's worthy of the seat.

    I would suggest that whoever was the first beaten candidate be deemed elected.
