1: I'm sure it was breach of the peace / failure to move on when directed. You know, the public order act politicians swore blind would never be used against protesters when it was brought in.

2: Because he hasn't been charged, so he cannot be named.

You have to remember, the Gardaí are on strict orders to clamp down at the moment. The Sunday papers were full of puff pieces on the Public Order Unit training away. Dissent is not being tolerated this week in particular

Section 8 of the 1994 Act will provide all necessary information.

Section 5 might also be important.

Where does the law allow for the gardai to be employed to remove slogans.

Who instructed the gardai to do so.

Is it not our right to protest.

FFS We are living in a fascist state, this is what they want to hide.

I agree an obstruction should be removed.

But who gave the censorship order?

    What did the sides say?

Sorry I messed up and started a new thread
    http://www.boards.ie/vbulletin/showthread.php?t=2056112845

Can a Mod fix it into one?

We are not a Facist state yet.. but Democracy is suffering when SF has to go to court to remind the Government to have a Donegal Byelection. How long are the other ones waiting now?

    The Public Order Act.

I admire your spirit, but the Gardai have had the power to move anyone at any time in any public space at their discretion for 20 years.

Also you need permission from the local authorities and Gardaí to protest. I assume he didn't have it.

I'm not saying that its a good thing, I'm saying its been like that for a long, long time.

Yes. They have authority to remove protestor and the crane. But Authority to deface/tear down the posters, interfere with evidence? I suspect not.

    Confirmation from Newstalk:

    Quote:
Anglo protester Joe McNamara who is charged with criminal damage to the gates of Leinster House has had his bail revoked.

The builder of Dún na Carraige, Blackrock in Co. Galway was arrested in September when a cement truck with the words ‘Anglo Toxic Bank’ was driven up to Kildare Street entrance.

He is reported to owe the nationalised lender €3.5 million.

He has been remanded in custody for breach of his bail conditions following an incident this morning involving a cherrypicker covered in slogans which was parked at Leinster House this morning ahead of the budget.
IIRC one of the conditions of bail was that he'd stay away from Government Buildings.

Newstalk have just reported he's been released after being charged with "dangerous driving".

Is this the developer Joe McNamara who owes 3.5 million?
And I am supposed to empathise or feel sorry for him.......why, exactly?
It's people like him who got us into this mess in the first place, and now he has the brass neck to complain about it?
And correct me if I'm wrong, but doesn't he describe himself as an unrepentent Communist? FFS, talk about a hypocrite...

why did they tear up his signs this isnt a dictatorship

A bit odd and questionable that the Gardaí decided that tearing the signs off the vehicle was a priority for them.

I've combined your thread with this one watty, as requested.

We are getting more like North Korea everyday. Can't be having any dissent against the leadership.

Surely the act of destroying the posters amounts to criminal damage?

I would say Joe McNamara owing the bank 3.5 million takes preference over his tacky signs.

Nothing allows the Gardai to act outside of the law, its dangerous ground. I dont think many including you see the significance of this incident.

The Gardaí, acting in a questionable manner to protect an Irish elite group? Well I never.
