Castletown Right of Way , KCC unbelievable....

    I am told that councillor Paul Kelly made a strong argument not to include the Castletown Right of way as it would prohibit the OPW from securing Castletown at Night. The Independents and Labour were the only groups to support the motion to include the right of way in the County Development Plan. The balance of power lies with FG, who voted against.

    The explanation given by the Manager essentially stated that any entry in the County plan for the potential right-of-way would be meaningless. If it is a right-of-way already then it didn't need to be included, if the route is not currently a right-of-way then there is a mechanism to correct that which is different from the County Development Plan process.

    Paul Kelly's reasoning was that in law a right of way has to be freely open 365 days a year and the OPW wouldn't be able to close the gates if it was turned into one; he also stated that a right-of-way must be along a defined route and doesn't allow roaming around the site.

    PS - Paul has just resigned from KCC as he has been appointed a judge on the District Court.

    Will this have implications for the new fence and the access points through the fence to Castletown Woods.

    Good luck to Paul Kelly in his new career. No doubt his expertise in relation to this matter and similar matters will be missed at council meetings.
