Right Of way

    There is lane between 2 houses with a gate .The gate is supported by both houses. We are told that we have no right to use the lane.

    Now the people that owned the house before us might have given written permission them to support on our wall.

    The owner of the lane concrete and paved the lane. So he says.
    The houses are 50-60 years old.

    I would be grateful for any help or suggestions

    Ring the gardaí and tell them that someone illegally attatched a gate to your property

    Who owns the lane would be the first matter to clarify.

    If the lane backs onto your property or if you can access your property via the lane you have a right to access it.
    You'll probably find the gate was installed as part of a small scale land grab by one of the neighbours,annexing the lane for themselves.

    The deeds to your house should contain a site map that will indicate any associated rights of way. Contact your solicitor for further info.
