Week after week I read more articles of Ireland's judges making decisions which make no sense at all. This week my local newspaper carries the appeal case of a drink driving conviction been quashed by a judge who said the arresting garda was wrong when he formed an opinion that a driver may be drunk.

The details of the apeal are in today's Western People, but are not online yet, however the original conviction was published here two years ago.

In both court cases the judge heard the following facts:

The accused was witnessed leaving a pub.
The accused was driving from side to side on the road.
The accused drove onto the grass verge multiple times.
The accused failed to use indicators properly.
The accused refused to Stop for a garda patrol car with blue flashing lights and sirens.

yet Judge Raymond Groarke, ruled that the Garda did not have enough evidence to form an opinion that the accused may be intoxicated...

This is one of Many minor cases every week, however we often hear of violent criminals getting suspended sentences for horrific crimes, often when they have dozens of previous convictions. We hear of violent crimes even murder and rape committed by sick criminals at times when they are out on bail or on early release.

This has got to stop before we become a lawless land, where the criminals have more rights than the victims. Oh wait maybe its too late!!!
