    Hi guys!

    If 3 people rent a house for a year , the year passes and 2 months in to the second year(no lease was signed for the second year
    ) one person moves out , does he get his deposit back? Has he any obligation against the landlord except the 42 day notice?

    Did the 3 people sign one lease with the LL or did they each sign their own lease with the LL? While they are now covered by a part 4 what sort of lease was signed and how the deposit was paid to the LL effects what actions the tenant can take. If the person moving out signed their own lease with the LL and paid a deposit to them then it's between them and LL to sort out giving the correct notice and getting their deposit returned. If the 3 people signed one lease and paid one deposit together then the LL can refuse to return the deposit until all 3 people vacate the property. Usually in those cases the remaining people find another person to move in and their deposit is paid to the person moving out.
