I've heard of a playstation emulator for Xbox but the only thing I'm wondering is whether that counts as hacking the xbox and will you get cut off from xbox live for it?

In order to run any homebrew application (though I've never heard of this specific one) you need to have the ability to run unsigned applications. To do this you need to be running a modified dashboard. This is easily detectable and will result in a console-ban.
