Is this the end of the Gazebo?

It seems that after the residents of Castletown have spent 4 years of fighting to save the Gazebo, Kildare County Council have signed an agreement with the owners which will see the Gazebo dismantled and handed over to the Council.

With no mention of a site on which to rebuild it nor any plans to actually rebuild it, it would seem that it will remain bagged and out of sight somewhere as yet to be decided by the council.

If it ever gets rebuilt, and that is a big if ,the owners will only have to contribute 15,000 euro towards the cost.
That is a derisory sum of money.

If the council do not rebuild the Gazebo within 7 years the owners wont have to pay anything.
This has now paved the way for the owners of the site to apply for planning permission to build on the site.
The fact that the Gazebo was illegally demolished seems to have been forgotton along the way.

They have not only driven a JCB been through the Gazebo they have driven a JCB right through the planning process and leglislation and gotten away scot free with it as well.

2 year old thread is not a reference. Have you got a reference for this agreement?

There is some information on the CRA website http://castletownresidentsassociation.com/doc/Gazebo_Letter_06-04-2011.pdf

There will be an article in the Leinster Leader due to be published next week.

I don't know what the worst thought is - KCC have got a bee in their bonnet with Celbridge, hence some of the bizarre decisions OR KCC are this bizarre right across the board.

Maybe it is the planning process and legislation that are bizarre.

A process that allows someone to:
    1. illegally demolish a building ,
    2. ignore an enforcement notice,
    3. then apply for planning permission to build on the site whilst the enforcement notice is still active,
    4. then take KCC to court and get a legally binding agreement that lets them off virtually scot free.
    That is bizarre.
