    Fingers crossed Cowell etc. see that releasing him from the silence clause would be stupid. It'd be a quick buck and give the "any publicity is good publicity" but it would be best for The X-Factor if it was like he never existed.

    X Factor bosses are reportedly planning to switch the judges' categories in a shock twist.
    The twist was allegedly created last night during crisis talks with senior staff, who are said to be "paralysed by fear" over Strictly Come Dancing beating The X Factor in the ratings last weekend

    There is likely a section within it that includes bad behavior, it penalties and subsequent still applicable binding contractual obligations.
    The X-Factor show has been down this road before so they have experience and are well prepared a great deal for such eventualities.

    Most of the stuff that has been in the papers, has been stunts and publicity that they, themselves created - so they can control much better - at their own speed and direction.
    However when something comes along like Frankies drug actions, that's something they know they can never ultimately control 100% - and if thats the case, it could only continue to riskily bring further trouble down upon the show and brand name ...and that means in the long term, effecting monetary gain alone besides other aspects as damaging the built up name of the business and reputation.

    Edit: Came across this which seems to bare out the above thoughts (here):
    Former X Factor winner Steve Brookstein has suggested that Cocozza's continued presence in the contest gave the show a "bad image" and was "damaging the brand".

    Sending him off now packing while still under a contract - now of silence for a while, is the small best situation of a whole larger situation that could spiral out of their control.

    When they get through to the live finals, they signing to their updated contracts - not just their competition entry forms - they allow/agree themselves to be tied to a form of employment contract and allow themselves to advance in the show under the then laid out conditions. Those conditions included in that contract at that point also specify certain penalties for breaking of rules and also (as the producers would have tried to plan ahead for any eventuality) damage limitation/silencing/no release of rival songs for a period of time, etc aspects.

    The missus reckons Johnny and The Risk back for an elimination this weekend. it would give them a chance to get back one of the favourites for the win. If they realised that people had stopped voting because they thought the risk were safe, it would be a nice cynical way to get them back in. Think of the money from the votes.......

    Gary is a twat for going for the caricature, rather than talent. And for Louis "The Gimp" Walsh to turn on Mankie this week, after all his previous comments? Even for him, that's some turn around. The one who has interest in anything other than novelty acts......Mind you, as someone said earlier, that Kitty would worry me. She's more bunny boiler than Glenn Close ever was.:eek:

    There was an article in the paper at the weekend - so if its in the papers it must be true :rolleyes: - that he had been out the weekend and brought a girl back to the house, went out for condoms and back to the house again!! Surely they can't be allowed to bring people back to the house!!?

    3. No leaving the house without permission
    4. Lads and girls must stay apart overnight

    Imagine how thrilled their fans would be to have them back in the competition again - they'd be voting more than ever to make sure they didn't get kicked off again (well for the first week at least).

    What they could do is give the finalists the day off and bring back the 8 finalists that got knocked out so far this season

    Have them doing live performances and the Public votes on which ones to allow back into the competition.

    On results night Dermot announces the acts that got the top 2 amount of votes out of all of them. The 4 judges then decide which one of the 2 to allow back.

    That would be the most fair way of doing it, though you would then need a double elimination again the following week to keep the numbers even
