Renting/Notice - HELP!

    Some Advice please

    Living in current place 2 years 3 months approx

    Signing one year lease at a time

    Can't afford rent anymore

    Rang to ask for rent reduction, refused, told them we were handing in our notice

    Their instant reply "You are NOT getting your deposit back"

    Talking back and forth.... we are breaking contact, etc etc

    Rang Land Lords mother (whom we have dealt with on many occasions, Boiler Servicing, Frozen Pipes, Leaking Showers, Leaking Doors etc)

    She was happy with the months notice, organise an inspection, give deposit back

    Today, Rental Angency rings, asking WHY are we going directly to landlord, you need to deal with US. You should never deal with Land Lord (despite dealing with her on numerous occasions to date)

    We told them we agreed with landlord about inspection, they said they are the agency we deal with them etc.

    We asked was the house up on DAFT? They said no, we need to see where we stand with all parties first. (The house IS up on daft, it went up today and we already know someone that called about it, blatantly lied to)

    So, we fear we will NOT get our deposit back, and are considering withholding our rent for the last month and walking away

    We think they will find any excuse not to give us our depoist back.

    We have had some issues:

    1)Being spyed on - An employee from the agency was seen peaking into our living room window and going around the back of the house to see if we had a dog on the premises

    2) We have had numerous issue with Leaking Boilder, Leaking Shower, Water getting in above the back door when raining, frozen pipes) - all above was dealt with by landlord - no issues there. We hasked for back/front door to be painted - took maybe 1.5 years to get this. We asked for house to be painted - never got painted. Handles on the drawers and presses in the kitchen to be fixed - never got fixed.

    We have had quartely inspections for the last 2 years all of which we have passed

    Any advice?

    We are going to seek legal advice

    Well you are breaking your lease so technically you are in the wrong and they could actually come after you for the remainder of the rent of the lease if they wanted.

    When was your last rent review? Technically you are entitled to one a year though if you have signed a contract as recently as the spring, surely you would have done that at the time?

    A review is a review, it doesn't mean it's going to change the rent.

    That's not the point I was making, the point was that once a year you are entitled to ask for one, and that is the time to make a case for reducing the rent. Or negotiating it at lease time.

    OP I don't think your issues re painting or handles would constitute failure by the landlord. Those are purely cosmetic and would not fall under any legal requirements in a property.

    Did you try asking the LL directly for a rent review? Have you spoken with the LL or the LL mother since speaking with the EA?

    I did that - the OP said they signed a new lease a couple of months ago. They also said they can no longer afford the rent and had asked for a rent reduction. This implies they signed a new lease and then asked the landlord for a rent reduction several months later.
