Hi, not sure if Im posting in the right place but please feel free to re-direct me. My O/H has a court order to see his son but while in court his ex made sure there was an agreement added, that he has to take the child on a particular wkend due to a family gathering. That was fine and he had no problem in agreeing to this. Now due to his job he has been posted to sea duties and this particular wkend is falling the time he has to go away. What does he do now???

The best course of action is for him to talk to his solicitor. He will contact hers and they can sort something out.

If he is on speaking terms with her perhaps your OH and his Ex can come to a mutually beneficial arrangement ?
Can a neutral person intercede ?
In the grand scheme of things this does not sound to amount to a whole heap of beans , it would be nice if this could be resolved without recourse to law.

thanks for taking time to reply. we really have weighed up all our options and there is no way out of it. Anyone who he would trust to mind the child is not able to take him. There is a stipulation in the order that says if either party can not comply then notice is to be given but Im not sure if this covers that particular weekend. Im just wondering if anyone has been in this situation where they could not comply with a court order?

HI,there are 2 things you can do, either phone the solicitor in the morning and explain your problem over the phone therefore avoiding the cost of a visit most will be happy to answer a simple question over the phone when they already have all the details! OR contact your local citizens information centre they have trained solicitors etc and are completely free of charge - hope that helps!!
