I was driving round my local town and pulled up to a stop sign. I was turning right from a minor road to a major road. I stopped at the sign looked left and right and moved out slowly. A car came speeding down the road and hit me on the driver door. He was over the limit arrested and charged with drink driving. My insurance company is saying im liable because i ran the stop sign. However my solicitor says its his fault. We are both insured with the same company. Can anyone tel me who is at fault?

Please note my car spun 180 degrees so he had to have been speeding.
