moving early, deposit?

    hi, im friends with a couple that just lost their jobs, were working together and have to move, they are renting and theres three months left in their contract, they will be giving their landlord a months notice and they asked me would they be able to get thier deposit back, im not too sure about it so i said id ask for them...

    What does their lease say?

    If they find someone to take over the lease then yes, they get their deposit back (assuming no major damage etc). If they cannot find someone then no, they probably won;t get it back unless the landlord finds someone immediately (ie if there is no loss to the landlord, he cannot keep the deposit).

    had a look at their lease and it doesnt say anything about not finishing it but they said their landlord is hard to deal with so thats why they are questioning it now

    If the landlord is difficult he might even ask for them to pay the remaining months rent.

    Strictly speaking-

    1. the deposit is solely for the purpose of restoring any damage caused to the property over and above what could be considered to be normal wear and tear.

    2. They are liable for the rent on the property until the elapse of the lease- unless the property is relet or sublet with the landlord's agreement. The landlord has to agree to allow the tenant to sublet to a suitable tenant. If the person who subsequently rents the property pays a lower rent than that specified in the original lease- the original tenant to liable to the landlord to make good the difference.
