A brilliant wheeze from AT&T. There's no data cap, there's not even a FUP estimate, but if you're in the top 5% you get throttled. (…….or you can move to a capped plan).
Starting October 1, smartphone customers with unlimited data plans may experience reduced speeds once their usage in a billing cycle reaches the level that puts them among the top 5 percent of heaviest data users.

Interesting to see if this kind of psychological device works as planned or if uncapped heavy users just move. Either way it looks like a win for AT&T

The second bit is even less subtle. The only way to cure this problem, implies AT&T, is for customers to contact state and federal representatives to make sure that AT&T's merger with T-Mobile gets the all clear; i.e. bring political pressure on the FCC.
But even as we pursue this additional measure, it will not solve our spectrum shortage and network capacity issues.* Nothing short of completing the T-Mobile merger will provide additional spectrum capacity to address these near term challenges.
