The boxes don't truly do Saorview as they don't have MHEG5, OTA updates etc.

They are only describable as boxes that can receive the basic video and audio of Irish channels.

Saorview is a brand and a trademark. As RTE are the owners of the brand and it is a registered trademark they are perfectly entitled to control how it is used. Sony won't tolerate any old Joe putting up the words "Sony dealer" on their shop or van and nor should RTE.
I think you've (and others) lost your way of what we are on about here. For a start, this isn't a case of people going around pretending to be from Saorview.

People seem to be looking at Saorview as "their own private service" and they "can do what they like". While RTE and Saorview can to some extent do as they please, they are still the state broadcaster and ANYONE is entitled to receive the tv signal and ANYONE is entitled to sell the boxes (approved or non-approved).

On the contrary there is nothing untenable about that view . Phillips do not have a registered retailer scheme so that comparison holds no weight. RTE has a registered retailer scheme and they claim the right the authorise the use of the word saorview and the saorview logo.
But that's a bit of a red herring. Just because a retailer is not on the Saorview approved retailer list, that doesn't mean they can't sell the boxes (approved or non-approved).

I won't deny that the guy in the market may well be selling the box as a Saorview box and may well not be telling people of the issues of no MHEG5, OTA updates, etc., and he shouldn't be doing this. But that what tends to go on at markets I suppose.

I agree, I'm not arguing otherwise

But there is a serious point made here about boxes being advertised as "Saorview" boxes when they are not - they may be able to receive the Saorview channels but they can't do Digital Aertel and more importantly, can't automatically update.

Adds: For me, approved Saorview retailers is irrelevant - I would prefer to use a retailer who is technically proficient and can talk in a sensible way about digital TV options. Getting the Saorview approved retailer tick would hopefully ensure that - but there are plenty of non-Saorview approved retailers out there who are good and really know their stuff.

Indeed. But when attending the market, and the "stall" not being an approved retailer, people will usually be getting what they are paying for.
And there is no direct evidence here that the boxes are being sold as fully complaint for Saorview.

No direct evidence I agree but the sign does say "Full saorview kits" which could lead some people to believe that they will provide all the features and have some connection with Saorview. To be fair though the market guy is not here to give his view and I agree with you that markets are generally looked at differently than a shop retailer.

To put this in context there are guys in that area (i've been told this by people who call me with enquiries ) who are changing aerials unnecessarily (for new "digital" ones" ) and generally trying to make a quick buck so I can see how the guys in Wexford would be sensitive to this .

Edit: BTW is the market open Fri and Sat and where exactly is it as I'm heading that way on Fri evening?

I completely agree. There is but one photo, with some boxes in the background. We just don't know for sure if he sells some cheaper saorview boxes. I also suspect that more people are going for combi boxes as so many houses have a sky dish in place and people want more than what just Saorview has to offer.

On a related note, we may talk about the compliance issue and how it may mean no interactive text or OTA updates but there is a more significant consequence. The Broadcasting Act 2009 maintains the language that equipment for receiving broadcast services available for general reception will need a license. (Section 140). I doubt that an mpeg-4 reciever capable of using the high profiles with AAC sound compatibility will be regarded as exempt from needing a TV license. Is there an argument to say that only saorview-approved equipment needs a TV license?

In the past, a TV with no EBU teletext would still be regarded as needing a license. MHEG5 offers more than just a text service now of course.

Exactly, smell of the 'Lynch Mob'!

I agree that that is an issue, but primarily one of consumer education. Saorview should be making sure that the advantages of buying 'Saorview Approved' equipment is widely understood. Given that they are the national broadcaster, they could, and should, be doing far more in this area.

Why must you be so dramatic? lynch mobs hang people, no one has died here.

Smell ? Must be a new feature on boards I've not heard about

I thought that drama was de rigueur, on these threads. On this thread, alone, we have: 'Destroying the TV Trade', 'Gullible penny-pinchers', 'Dodgy Equipment', 'Fencing', 'Cattle Branding', not to mention that 'High Horse' you've been accused of sitting on. :)

    Give me a break...
