Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Labour Court / Equality Tribunal getting your costs.

    General question, there are reports of a lot of unfair-dismissal type cases happening in 'these recessionary times'.

    Say an employee takes a case against an employer with the Labour Court or the ET and the case is frankly ridiculous, gets thrown out, but employer is still left with a shedload of costs.

    Is the employer stuck with the costs of defending the case?

    In a court of law I understand you can make the arguement that the 'prosecution' case is baseless and they should lodge monies to cover the other side's costs; is there any similar mechanism with the lab court or the ET?

    The Rights Commisioner, employment appeals tribunal, equality tribunal etc are excluded from awarding costs. In certain situations expenses may be awarded.

    In relation to Courts a application for security for costs order is usually only granted against a company or a person who is not resident in the state. If I remember correctly such order can not be granted against a person resident in Ireland.
