esb - charged for usage spikes due to faulty wiring/appliance

    Hi All,

    If there was a situation whereby a tenant was renting an apartment, and they had no access to the electricity meter to read their units. The apartment itself is relatively new and through the past few years this tenant has been receiving pretty accurate electric readings estimated/actual, but has had a problem with the lightbulbs in the apartment blowing much more regularly than is normal (on average a new lightbulb had to be replaced every month). The landlord was not notified of the issue over the course of an entire year, until a bill is received from ESB (estimated) in excess of €300, which is also 3times more than the average bill. Upon making some enquires the ESB suggest that there is a fault with an appliance (such as an overhead extractor fan above the oven) or a fault in the actual wiring itself inside the premises, which the landlord was not notified of.

    My question is this, who should foot the bill for the electricty. Assuming that the tenant has had the meter checked and confrimed that the usage was correct. The tenant had not notified the landlord of any concern due to there not being any change in the ESB bill for an entire year?

    Has anyone been in a situation such as this before? What will happen to the money once its been deducted from the tenants bank account? Where does the tenant stand legally if they dispute the bill and demand the Apartment Complex management company are at fault?
