Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Just looking for some quick advice

Last oct I moved back to Eircom after getting an anytime calls package for 30.00 per month, with the added enticement of being told my line had been upgraded for non congestion broadband and to expect speeds of 6-8mb. Was under different contract for mobile bb so only recently looked into this. The salesman also told me not to move away from eircom if getting better price as they would be in a position to price match.
Anyway mobile bb contract ended so I rang re getting the new eircom fancy bb i the house - Not only was the line no upgraded but was told it may never be and best speed I could expect was 2mb non congested bb. thought this was strange so got on to their tech team who told me that there was no non congested bb available in my area and both salespeople had mislead me. Then also was told that my anytime package was only 30.00 for 1st 6 onths, then up to 35 , even though this was not stated at time of sale , nor is it on the contract.
I was and still am extremely angry at being deliberately mislead, not to mention the run around they give you when you try call them, being passed from one dept to another with calls mysteriously dropping too.
Checked the contract I have and noticed that it is not dated , nor is their any ticks in 7 boxes that are stated "must be signed by customer" (basically boxes that you understand such and such and agree to same)
I now want away from this shower asap and was wondering if the contract is valid as they have refused to cancel same and have threatened legal action if I cancel direct debit. I get the feeling they are calling my bluff and hope I will go off with my tail between my legs, even though on several occassions they have admitted that the salespeople were a tad liberal with the truth.
Also is this something I could take to a small claims court , where the likes of eircom have less power ?
Whatever the outcome, worst case scenario is to see out the contract, but I will never deal with this lot ever again and would advise anyone thinking of dealing with them to do so with extreme care.
    Any info much appreciated.

Start harrasing them to speak to the manager's, manager's, manager's PA and that you will be making a request for all telephone recordings under the data protection act.

Tell them you will also be reporting them to the regulator.

I've had UPC for years (even since smart started buggering about with download limits) and never looked back - its a bit more expensive but I dont mind when I'm downloading p... er.. non copyrighted HD videos on my 30mb line :) - an I'm in a crap UPC area!

They are under an obligation to supply them to you - get back on to them and ask them what their data protection act fee is (will be less than a tenner) and send them in a letter requesting all data held on you. Point out that anything with held my prejudice their defence in court. (Complete rubbish but sounds good to the 7.65 an hourer on the other end of the phone).

If they then refuse to supply you with a copy of the tape (they may not have transcripts) you can assume it doesnt exist anymore and they won't be able to rely on it any more than you.

ABOVE ALL remain calm and be as nice as pie - I know it's difficult but raising your voice really won't get you anywhere. Persistance is key and asking to speak to managers. When I used to cahse things up in various roles I always used to have the speaker phone on and do somethig else - they'll keep you on hold for the craic - just stay there and keep pestering.

My best one ever was a three hour phone call the Byte - I eventaully eneded up speaking to a director and got some nice upgrades for my PC for free :) Thinking back is was probably my fault it was doing what it was lol.

I was in an almost identical situation to you, the phone staff do not have the mechanisms to help you. i.e they are allowed to do x and y but you have problem z. Dont bother calling them again as it wont help your blood pressure. If you ask for a manager the line will be dropped.

E-mail the problem as a complaints, the people who deal with these complaints have the mechanisms available to help you.

I had to eventually e-mail them scans of the contract I was given because they claimed the deal I was offered does not exist, reading the smallprint we agreed they were bound to the contract for 12 months.

Let us know how you get on.

    P.S. i got that deal for 21.99 a month

Somthing similar happened to me with Eircom. I ended up getting a solicitors letter from them. They ended up loosing and paying me money back. Posted on boards about it infact. Horrible customer services. If you talk to Eircom , they use the following line all the time " we cannot guarantee speed " Unfortunately they use it after you sign for them. The sales people never use it.

I recently signed up to Eircom on a package deal. The agreement was that €47.05 I would have phone and broadband and evening and weekend calls. That was fine. First bill arrived and the direct debit paid it, didn't look at it very closely it was small enough.

Anyway during the week, knowing I was due another bill I rang the day it had been issued to discover that the bill was €97.92. I questioned this because in my household budget I had allowed €60 for the bill (extra few quid for any calls over and above those allowed on my package) I was told that there was €15.64 in extra calls, I took no issue with that. But I was also told that there was €25.71 in "part period rental" for my broadband. When I signed up to Eircom I specifically asked was I ok to use the broadband straight away (because I was told that the calls package wouldn't kick in until a certain date so I would be charged full price for any calls made prior to this date) I was told that there would be no extra charges for the broadband and to work away. I raised this as a query with Eircom during the week and there had been considerable issues with the broadband (turned out to be a faulty modem)

So after all of that on Tuesday they gave me a credit of €60 to compensate me for all the hassle. I rang the billing section later that day to see had the credit been applied and I was told it had but if I wanted it to come off the bill that was due then I had to pay the balance of €37.92 in advance of the direct debit due date. I paid on the spot with my Laser. I was told that it would take 3 days for this to appear as paid. I rang this morning to check that the bill was cleared down as the direct debit is due this day week and then I get a whole different story. I was told that the balance of €60 would be taken on direct debit on the 18th. It was not possible to speak with a supervisor to discuss this matter I was not allowed to by the agent I spoke with and he actually started shouting at me.

Has anyone got any ideas as to whether or not Eircom can do this?

Having similar problems with Eircom too actually, signed up for bb and phone deal at 20 a month for the first 6 months and 40 a month thereafter. Eircom broke their deal with me, when I complained and faxed me over the contract, they informed me that I had in fact signed on to the deal and they hadn't given it to me the terms of our contract. They promised to rectify the mistake the next months but the next bill I got they still hadn't given me the terms of our agreement. So I am taking them to the small claims court, I thought I was the only one though, its bad form that it appears that other people who signed up to that deal are not getting it too
