Rights to see child on breakup

    Hi everyone me an my partner of 5 years broke up, we have a 1 year old and I rarely get to see her as i don't live with them anymore and she gets to say when and where I can see our child, do I have more rights in this situation?

    It depends on if you and your child's mother were married or not I'm afraid. If you were then you have equal rights - but may still need to go to court to establish access, custody etc. If you were not married then you have absolutely no rights to your child unless the mother has signed a Statutory Declaration giving you joint Guardianship -as part of that declaration an agreement re: access/custody is reached prior to it being signed.
    If this is not in place and the mother refuses to sign it you may need to go to family court I'm sorry to say.
