Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

No fault car accident. Car being written off.

    What recourse does one have if one is told that their car is to be written off following a car accident in which one has no liability (ie someone else crashes into that person).

    Is one obliged to accept this judgement.
    Surely one didn't ask to be crashed into and only wants the car restored to how it was before the accident (economical vs uneconomical repair should n't come into it should it?).
    Surely the fact that one is blameless (no-fault) trumps "uneconomical" in determining how one wants their car repaired.

    Depends on the write off category. IF cat A & B car must be disposed off in accordance with EPA and Dept guidelines. If cat C & D trade repair may be possible.
    You need to establish what cat of write off the car is.

    You cant expect an insurer to pay more to repair a vehicle than what the vehicle is worth or repair and put back on the road an unroad worthy vehicle.
