    Hi all,

    We have a little company making furnitures.Just find out an other company was using 10 of our pictures from our website. They were advertising them like their own. We took screensoots about the sites.
    We went to a layer, but they were refusing anything what we were asking. The only thing what they did is removed the pictures from their site.
    I was talking with two different specialized solicitors and they both said the same to just leave it....Is that it????So anyone can use any pictures on the web without any problem???It doesnt look right for me. Anyone has some advice?

    So they used 10 of your pictures, you asked them to take them down and they did? Are they still infringing on anything??

    Regarding infringement under the 2000 Act: it states that it won't be infringement unless you tell them to remove the content, the implication being that the infringement only occurs after you have informed them and they have refused.. Since they have then I would just leave it.

    But I'm just some random guy on the internet. If you have already spoken to two specialist solicitors who have told you to leave it then you can bet that you don't have a strong case. Listen to the professional legal advice.

    No that was it.They removed them after.Its just unreal u r make a design than make a product than u just saw ur job on someone else website n he is advertising it like his job n that's it it doesn't hv any consequences....:S

    What else do you want out of it?

    Unless they're copying your designs, which isn't as much a copyright issue as a design right one, then all you can do is look for a take down. It's a photo of a product and nothing more.

    As they were using your pictures of your products, have they been making similar items and selling them - presumably this is the point of the photos?

    Use watermarked photos in future.

    My point I always thought U cant use someone else picture without their permission. (specially when its about advertising-selling a product)
    And if you do u will be in trouble I mean they can do something with you like u hv to pay a penalty or something.
    But I never thought as I can see now U can use any pictures from anywhere on the web without any problem. If they discover it u just remove them and thats it.... :confused:
    So basically I cant see the point of Copyrights at the moment.

    You cant use pictures from the web without any problem. There is a problem if you infringe copyright and refuse to take it down when asked.

    You need to get over it, if you want to sue then go instruct a solicitor and sue the other person. There was no damage done, they used pictures and took them down when you asked.

    What do you expect to happen in court?

    He used my pictures!!

    If you cant see the point in copyright, perhaps you should study it like the rest of us.

    I was asking opinions and advice here because I dont know whats the story.
    Probably if i would go and study about it I wouldnt ask anything here.
    I didnt want to hurt anyone feelings here in any level.
    Probably people are asking things what they dont know on places like this, and people who has experience or maybe knowledge they are sharing there opinion.......
    I didnt want profit.
    Just when we were calling him n told him to delete the pictures the level he was talking with us was unreal....I think that is understandable if we were angry.
    Im really appreciate everyone's answer here.
    Now Im going n study about copyrights!!!!ok No Quater?;)

    You think you can get better advice on the internet from people who could be plumbers against 2 specialised solicitors!?? People cant be punished for being angry, I'm sure you get angry yourself! Even one person here told you to just leave it too and then you start complaining about copyright being useless!!

    I just dont know what you expect!

    i didnt expect anything.I just thought maybe there is someone who had a similar situation.Of course i will leave if there is nothing i can do.But I dont think there is anything wrong if I just wanted to ask someone else as well.

    Well... We took a company to court for copyright. It cost 10 years ago approx 40K IEP, the others side costs were much higher as they used one of the 'top' law firms..., we won and even then it then took years to get any money from them.

    Your solicitors are right, for a few photos when were taken down, it is not worth the cost, effort, aggravation and sleepless nights.

    When is the money (including lost growth) Michael Noonan took in the Pension Levy going to be paid back?

    It does not matter how big company you have if you have the rights of a material then its yours, no one can use it.

    Yes, I know :S That's why I was confused about this thing.I will use watermarks on them from now on. Because like what everyone said not worth to do anything .:(
