Notice required outside of lease?

    Hi folks,

    If your lease has been up for the best part of a year, is there still a required notice one must give?

    Absolutely, you have automatically entered a Part IV tenancy and the notice periods are based on how long you've lived there.

    Less than 6 months - 4 weeks (28 days)
    6 months to 1 year - 5 weeks (35 days)
    1 – 2 years - 6 weeks (42 days)
    2 or more years - 8 weeks (56 days)

    I read the PRTB handbook a few years ago and I'm pretty sure it said that no notice was required by Law in order to be entitled to receive the full deposit back.

    (That is the case even if you've signed a lease.)

    So I think outside of the lease it is only good form to give notice, not the law.
