    If a person was to rent out a place on a one year lease but wanted to move out after nine months, what happens?

    Are you liable to pay the full last three months?

    You would have no claim to getting your deposit back, but that is usually down to the landlord. You would usually be obliged to find a replacement too, but I may be corrected on that.

    Irish law allows a tenant to break a Fixed Term lease by assigning the remainder of the lease to another person who takes over the lease. The vacating tenant is responsible for finding a suitable "assignee" who must be equal to or better than the landlord's requirements for a tenant. The expenses of finding the new tenant is the responsibility of the vacating tenant.

    If the vacating tenant fails to find the new tenant, he is liable for the rent until a new tenant takes up occupation as well as the landlord's reasonable costs in finding a tenant.

    Legally, the landlord, the out-going tenant, any remaining tenants and the in-coming tenant should all sign a Deed of assignment which sets out the terms of the assignment.
