Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Neighbours dog bitten 4 times

    The neighbor has made continuous excuses for their aggressive dog. Its bitten people including her and her friend recently and attacked and scarred another dog.
    She claims if someone goes near his house its there fault and hes entitled to bite.

    I hear in the uk the dog must be put down.. is that not the case here in Ireland?
    Does the law protect people from this and what can be done?

    There are various things you can look at:

    Control of Dogs Act

    Occupiers Liability Act

    More practically you could ask your local dog warden

    There's also your basic run of the mill negligence and the specific rules relating to animals such as scienter. Doesn't 'protect' the public per se, of course, its more of a remedy if things go wrong.

    There was a time when every dog was allowed its first bite as far as civil liability was concerned. Those days are long gone and the owner needs to cop herself on before something more serious happens. Plastic surgery can be painful and expensive!

    I would have thought the "scienter" rule applies, owner has knowledge that dog is violent thus is liable if dog attacks.

    Indeed and Rover is not allowed one free bite! Owner may be leaving herself open to prosecution too if the dog inflicts an injury.

    Isn't that a rather vague statement???
    In that case if a friend invited me round to visit, and during that visit their dog were to bite me, it's my fault???
    If your mailman walks up your driveway to deliver your mail, on your property, and your dog bites him, it's his own fault?????

    This should be moved to the animals and pets forum.

    Although all you'll get there is a sympathy for the dogs mental health an the anguish he feels.
