BER ratings in rented accomodation?

    Is there any legislation on BER ratings on rented accom in Ireland?
    Like, is there a minimum standard they have to meet?

    Just, I've rented some houses that were so draughty that it was as if they were build with 5 year olds with lollipop sticks.

    Are landlords required to provide at least a minimum level of insulation etc?

    The only legal requirement regarding rented accommodation and a BER cert is that any property offered for rent (or sale for that matter) should have a an up-to-date one. This requirement has been in place for a couple of years now but it is being largely ignored and nobody in authority appears too bothered.

    However, a BER rating only gives you a vague idea of how much energy (and therefore cost) it will require to heat the property while the report will indicate actions that could betaken to improve the rating. So any property can get a BER rating even if it s a bottom of the ladder 'G' rating.

    The standards for rented accommodation do not set any minimum BER rating that must be attained. Nor is there an specific mention regarding insulation. They do state that the premises should be of sound structure, free of serious rot and damp and have 'effective' fixed heating appliances in every habitable room. Full regs here (pdf). Some of them will only come into effect for older premises tenancies which commenced before 1/2/2009 from 1st February next.
