And the Examiner says the other charges were struck out, but not why. Bloody typical. What happened to mandatory 5 points??

    What mandatory 5 points?

No insurance: 5 penalty points and a fine of up to €2,500 and/or a possible term of imprisonment

For conviction of having no nct.

I meant for the nct. Would have been mandatory 5, where isn't no insurance up to 5?

Maybe the points do apply but they just didn't mention it.

No insurance + no NCT = 10 points. But I'm skeptical that she will get the ten points. Maybe five, if any.

Pretty sure that's up to 5 points not mandatory.

Either way she looks to have be punished very lightly

You only get one set of points for any conviction, dont you? As in, she would only get the points for whichever single offense carries the highest number of points. Ridiculous system...

    Yep, sorry, you're right.

So five points then. Or so it should be anyway.

    I loved this bit:

The TV and stage entertainment veteran was warned by a judge that she would be jailed for five days if she does not pay the fine within five months.

So basicly for combination of offences she just got a 1000eu fine and a warning to pay it in 5 months or she will go to jail for WHOLE 5 DAYS!

I am pretty sure if one of us would do what she did, we would be arrested on the spot and waiting for trial behind the bars. I am not even talking about fines and ban of road for 200 years...

Those points were just resting on Ming's license though

The Judges are afraid of the Pantomime season, they have to look out, for the impression their Grankids, might make of them.

What a joke! If the average Joe (not that Joe!) got caught they'd be banned for several years at least with a hefty fine too.

I was surprised to read she "had no prior criminal convictions" - i was sure she had been trouble for something - other than leaving abusive messages on people's phones of course. I must have imagined it.

LOL. She should have gotten Darragh o Se's solicitor!

her barrister was quite competent in court and the result was quite good given the amount of allegations/charges against her on the previous occasion.

It takes awhile to get the message down to the southern states, I know I live in Wexford.

Darraghs solicitor got all the charges against him dropped. Even the judge questioned in court why they were dropped!

I do know the case and know the judge.... and personally I think that situation should be investigated, but the twin case was a good result given the reality of the situation she faced, in the other case there could have been errors made on the garda procedures - which would have been embarrassing for the gardai to admit before a court..... unfortunately we'll never know. (well some of us won't)

I totally agree - it does happen, all you have to do is sit in a district court for half a day to see this, but then again the law is made of loopholes and its those with money/connections/the time to find and understand them that can avoid prosecution or get reduced sentences.

I've been before the courts for traffic matters in the past and on each occasion I've had the case struck out, not because I got away with anything - simply because I managed to argue my case correctly and in every case it was an error by the people involved.

once I received a fine for non display of tax - i was in the tax office getting the tax disk at the time but didnt receive notification until a few weeks later, I phone the Garda involved and he tells me to bring it into station, I do this and he says dont worry about it, a few days later .... another notice, same garda, same offence, same place, time etc ..... couple of weeks later, court summons, I turn up to court, garda doesnt turn up - but I have to take a day off work and when judge calls case... no garda (apparently he was on holidays), strike out is given.

on another occasion I was parked in a loading bay (I have a van with commercial tax/insurance), however this loading bay had faded double yellow lines and I returned to continue unloading my van to find a ticket on the van, I refuse to pay and end out in court, I show the judge photographs of the loading bay and the double yellows and he basically says you've told me one version, the garda tells me another version of events.... strike out.... on each occasion I'm out of pocket for the time and effort I have to do to fight incompetence .... but if they dont bring cases before the courts they cant get the statistics/numbers up !!!
