12 year old house BER before Sale

    We are currently trying to buy a 12 year old house which is currently occupied by the present owner.
    I have read that its a legal requirement to have BER before house sale.
    Would this apply in this case? Our solicitor said its not usually complied with. We have had survey done on the house and said that the BER rating should be good but obviously this not an official BER.

    Your solicitor is wrong. The seller must have a BER and the sale cannot close without it.

    The intention of the BER is so that you can compare the cos tof living across prospective houses - in reality there are MANY more important factors in choosing a house, but in reality when we bought ours, we did consider it's energy efficiency / comfort, and did factor in the cost of any upgrades necessary when considering the price to buy...

    BTW Solicitors are like any tradesperson where they must do a service for a client - they will do as little as possible for the max money, as that is how they are incentivised...no harm to check they do ALL of the needful!;)

    Something missing from that article I linked to, but we're onyl finding out about now - check has the property tax been paid, and get the solicitor to source the exemption certificate for same, otherwsie in buying the house you would be liable for the outstanding debt if it hasn't been paid previously...
