So we bought a car 2 months ago, had it checked over spare tire in the boot everything was fine. We verbally agreed with the seller that we would take it on a trade in for our car.

A week later the deal was done. It wasnt until we were going out and put the dog in the boot, we noticed a dip in the floor. Spare tire was gone. We called him up straight away and he apologized. He said he would have one in 4 days for us. 4 days later nothing, this went until now (2 months later) Still nothing We have the NCT coming up soon so will need a tire for that.

Do we have any come back on this does anybody know ?

If it was a private sale - you have zero comeback (unless the seller is uber nice and looks after you)
If you bought from a dealer / trader you may be entitled to it but after this lenght of time you probably have a job on your hands getting them to sort it for you.

If I were you i'd head to a scrap yard and pick one up for a couple of quid and save yourself the hassle

Just on the NCT. A spare wheel is not a requirement, so no problem there. Still that does not answer why this idiot decided to remove the spare after doing the deal.

Not so. The spare was there when the deal was made, so it is part of the consideration that passes under the contract.

It doesn't fall into the jurisdiction of the Small Claims Court, but you can take a case for breach of contract in the District Court.

It's a bit of bother, but if you are sufficiently annoyed it makes for good therapy.

As said above , a spare wheel is not required for NCT .

You could buy a full wheel with decent tyre in any car dismantlers for €20 .
