Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    Given the following case, would it be possible to get some advice?

    Paddy, a window cleaner, engaged by St. John’s School in the city centre, takes five minutes out of his working time to go to the bookmaker and place a bet. He leaves behind him a thirty-foot ladder, on the pavement outside the school, stretching up to the window on the 2nd floor of the school. Children aged from six to twelve are clustered around the area waiting to be collected.
    One of these, Anto, aged ten, climbs the ladder. He is a ‘streetwise child’ of poor academic achievement. When he is at the top of the ladder a car, driven by Ciara, mounts the pavement and hits the ladder, knocking Anto to the ground and injuring him severely. It transpires that Ciara was driving to the school at speed to collect her daughter, Mary, who had burnt her hand in a science experiment earlier in the morning.


    I have to oppose Anto’s claim. I have to identify the various potential defendants and present written legal arguments (referring to relevant legislation and case law) as to why any claim Anto might bring should fail.

    Any help on this would be greatly appreciated.

    Remoteness.
    Contributory negligence.

    Avoid mentioning the red herrings like Anto's academic ability, its irrelevant.


    Do your own homework, we all did ours so wont do yours for you!!
