Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Libelous? Media reporting / non-reporting of events

    Hypothetical, here.

    News of the day is that Corporation A has been doing something they shouldn't. Media-outlet B runs their coverage of the day's events, and either under-reports or fails to report Corporation A's transgressions. B is sponsored by A.

    Individual C comes along and writes a piece to his blog about B being compromised due to sponsorship ties (could be political ties, that kind of things though)

    Can B come along and slap a libel case on C for reporting what may or may not be true, based on the perceived facts?

    If it's an honest opinion based on facts there may be a good defence.

    If the Blog piece is defamatory then Media-outlet B is absolutely entitled to bring an action for Defamation agaisnt the Blogger.

    the blogger however May have a number of good defences, Truth being one and as mentioned, Honest Opinion being another. Its all contained in the Defamation Act 2009

    If the above was some sort of exam question might it be digging at the defence of qualified privilege?

    Perhaps not an issue given the previous two defences outlined.

    no no no that defence would not apply in such a circumstance, Fair and reasonable publication on a matter of public interest is the defence you are thinking of. Section 26 of the 2009 Act.;)
