Help with insurance claim

    Some tool crashed into the misses car, he has claimed full responsibility. The garage want to write off the car but are undervaluing the car in that its not possible to replace the car with the same model.

    Any tips on how to get them to pony up the correct amount so a replacment any tips on how to get them to increase the amount, can I force them to repair the car?

    Would a solicitors letter help them along, could I just bring a claim agaiinest the other driver ?

    The garage are undervaluing the car, or the insurance company?

    You could appoint your own independent assessor to check the damage on the car and the Pre-Accident value.

    The insurance company are undervaluing it.
    I'll look for an independent garage tomorrow.


    If we do decide an a value, do they give a loan if a car so we can get around to view other cars? Will they compensate for the remainder 6 months worth of tax? I don't think it's a class a or b write off .

    You need to demonstrate that your car is worth more than they're offering for it, using the example of similar cars currently on sale. Don't alienate the assessor, it's not his money and he'll be more inclined to work with someone he likes. Be polite, but firm.

    Tried that with them with a written-off S40 in January, they're very disinclined towards believing anything but their own opinion. Showed examples of lower spec models/higher mileage/not tested on sale for more money but they barely budged.

    I appointed my own independent assessor and ended up getting €375 less than the insured value on the car. Took weeks of fighting, lots of mails and information being sent to the insurance company, and quite a bit of additional stress.

    It does help that a large part of my job is valuing vehicles, so they were trying it on, on a specialist subject of mine, so I held out until they came close enough to what I was looking for that it wasn't worth further arguments for small money.

    They wouldn't pay my consultancy invoice for doing their job for them either - feckers.


    OP - What are the details on the car? Make/Model/Type/Year/Mileage/Extras/Pre Accident Condition

    They'll only give a replacement car if that's covered under your policy. We got €200 of car hire with ours, which covered just over 2 weeks earlier in the year, but at this time of year it won't cover anywhere near as long.
