    Asking on behalf of my mum

    We had an apartment rented and when the previous tenant handed in her notice we were lucky enough to get a new tenant to move in before the current tennant moved out. The new tenant was having problems where she had been living so the sitting trnant was kind enough to let her move in for two weeks before she moved out.
    The day before the new tenants lease offically started she contacted mum by text and said she had to move out immediately. She had paid her deposit but no rent for the first month in the apartment.

    The new tenant has now started looking for her deposit back which due to us being unable to relet the apartment for a month together with the readvertising costs we are reluctant to give any of it back to her.
    She is now going to the PRTB with a claim against us in relation to the retention to the withholding of her deposit.
    Does she have a valid claim against us??

    Did the new tenant sign a contract?

    If she did, then she is laible to loose the deposit.

    I would contact PRTB as well to find out their thoughts.

    Yes she had signed a lease but she claims that it hadnt started yet as she moved out the day before it started
