Paying for a space doesnt mean you no longer have to obey the law. Its notsome magic piece of land .
Hes paying for the use of the space, it doesnt become private property.

You are, of course, 100% correct, if the OP did not contact the relevant dept. to inform them beforehand that his/her car was going to be off the road for that amount of time. Now, if it was only a week or two out of date, there might be some chance, as it says on the renewal notice, you may also tax the vehicle during the month in which the tax becomes due. The only other avenue, imo, would be to take a chance and appeal the fine, and it might just be deemed as mitigating circumstances the fact that the OP had paid the Council for that parking space for the year, then again it may not.

Even if they declared the car off the road they would get fined for it being in a public place

It's black and white dude. No current tax displayed - offence - ticket .... Cops can use discretion ... Traffic wardens don't have that option ... Take your chance ... I

Of course traffic wardens have the option of using discretion.

They can just walk by the car.

They're not under obligation to put a ticket on it.

Not exercised very often I may add.

They are under an obligation to do their job, for which they are paid.
Motor tax evasion is a significant cost to the public at a time when public finances are in tatters.

I don’t know for sure but it was my understanding that you could get a Garda to sign a form stating that the vehicle was off the road for a specific period of time. You now have to inform someone (presumably the Tax Office) right at the start of the period when you are taking the vehicle off the road but that is a recent change in the law so depending on the dates you may still have a chance.

The fine is incurred for 'non-display' of a tax disc. Even if you had the tax paid up to date but didnt have the disc in the holder, you'd be liable. Saves them having to deal with 'I have it but I forgot to put it up' and 'it's in the post'.

    Pay up.

Will a traffic warden fine you for tax if its within the one month, ive heard of 2 weeks out being fined in cork.

They will and do.. There is s small grace period the garda will grant you at check point I think its 11 days or 2 weeks but once your parked your fair game if its up by one than a day.

They are probably on a commission.

Road tax is a great revenue earner for the government. It is too low in many respects...a lot of people say it's the law. The govt should play on this.

They could whack it up to a minimum of €500 per car, regardless of engine size.

Load of crap. Where is the law to support this? No tax - offence - summons.

Grace period - no such thing ...

I think that's very much the problem. The guards are often too lenient. They often let people off for various offences so after a while people don't think they are offences anymore and expect to be able to push the boundaries even further. If you're being left off for a month, sure, leave it 2 months so before taxing. it's only a month out of the "grace period".

If you got a on the spot fine for being one minute over and there was no budging people would soon cop on.

I like the UK system where they send off a car to the crusher if it doesn't have insurance for instance. There's no messing about!

that's not strictly true. They impound the car and wont release it until the documentation is in order and the storage /towing fee paid, plus any fine etc.

After a certain time if the car isn't claimed it is disposed of, either sold at auction or crushed if of little value.

Same as here. After 3 months out can be seized ... Pay to get it out. Should be crushed ... Put a stop to evasion very quickly ...

I can't be bothered looking it up for you as you obviously know best. But there is a legal grace period and I believe its 11 working days. Your local tax office will advise.

Perhaps you don't understand what grace is.

    Hint: it's not before meals.
