I recently split up with my partner not married and we have a ten year old girl her mother just took her out of the family home three days ago but my daughter doesn't want to live with her mum she keeps asking me to take her back home what are the implications if she comes to stay with me and she won't go back to her mother

What I want to know is if my daughter stays with me and her mother comes to collect her but if my daughter won't leave can she physically remove her

No I applied for it

As the law stands the mother is the sole legal guardian, its a crap situation but you may wait until your application goes through.

My application is not untill October if I had guardianship could she have stayed with me
