After months of wait my sister's (her husband and daughter's) visas has been refused with a reason that they will might not observe the visa conditions and will not return to their country. I want to write an appeal letter now, any tips are welcome. Really depressed.

Not legal advice but an opinion based on watching "Nothing to Declare" an observational documentary series following Australian customs officials.

You need to stress any and all the "ties" that your sisters family have with their own country.

ie. That they have lots of reasons to return home.

Contrary to popular belief this area of law is very complex. Not only must an applicant know the law they need to know how to present each fact in its best light. The only advice I can give you is get a lawyer who specialises in this area.

As the other poster responded information about the husbands employment in the other country and the child's education etc. contrary to popular opinion ireland is a very difficult country to get into.

The law is complex but ought not to be so complex that a tourist should be in need of an immigration lawyer. I appreciate that is nevertheless the case from time to time.

OP What is the current immigration status of your sister?

Sorry about another question but, just to be sure...

Does your sister have a residence permit/ card for Ireland or elsewhere in Europe?

If not, the regular visit visa rules apply and all the non EEA family can do is emphasize their economic and other ties they have to their country of origin.

Thanks, no she has no link to Europe :( .. I thought family visit visa might be different from regular tourist visa but you are right, they considered it like a normal visit visa. I am going to appeal in a day or two, lets see what they do ..
