Minumum wage - how is a year of employment calculated?

    My 22 year old son has paye balancing statements for 2009,2010,2011 and 2012 showing that he worked casually whilst at college.

    Will this be taken into account if he were to take a position offering the minimum wage i.e. would he get €8.65 or would he get €6.92 an hour. I couldn't find anything online that said whether the first year of employment was 52 weeks or if there was a minimum number of weeks required to qualify.

    The National Minimum Wage (from 1st July 2011) is €8.65 per hour. The National Minimum Wage applies to all employees except:

    Employees who are in their first year of employment since turning the age of 18 (€6.92 per hour)
    Employees who are under 18 years of age (€6.06 per hour)
    Employees who are in their second year of employment since turning 18 (€7.79 per hour)

    If he worked in 2012, then this is 3 years after turning 18 meaning he is well past his second year of employment since turning 18. He would be entitled to €8.65 per hour.
