Issue with ASUS and Pixmania

    I ordered a New Asus sabertooth motherboard and some upgrade parts for a client
    i get the board and it installs fine but then the sound does not detect audio jacks, the raid randomly fails,windows randomly deactivated, and running slow in general. i have another identical build and its perfect.
    I contact asus and they say rma it to be repaired.
    I send the board back telling them that i want a replacement that it has to be sent to asus and replaced and a copy of the asus support , all this inside 2 weeks.
    5 WEEKS LATER i get the same board back from pixmania with a letter from e-merchants with the board problem listed as "keeps freezing and turning off"
    nothing is fixed or replaced.
    i call and they say they can try again but e-merchants will have to decide if it is faulty.
    Its now almost 7 weeks with no working motherboard and about to be 86 euro down from sending this broken board around.
    and i cannot send it back to asus because the french warranty does not cover UK and Ireland. and asus said i should not have been sold this board because of no warranty support
    This is just a complete fail on Pixmanias side

    Due to the specialist nature of PC components a practice has grown up around them where customers deal with the manufacturer rather than exercise their consumer rights under the contract of sale. In the US where manufacturers have local RMA depots etc this is a wise thing to do as you generally get a faster and more efficient service with expert knowledge and support. In Europe it's a complete mess and is best avoided.

    Your contract of sale is with Pixamania, although they are based in France the contracts usually conclude in Ireland and are subject to Irish Law. Pixamania bear the responsibility of dealing with the issue not Asus despite what Pixamania or Asus may say. Pixamania may, of course, send the item back to Asus but all of the sending back and forth must be completed in a reasonable time, as not to cause inconvenience to you as a consumer.

    My advice is to stop dealing with anyone but Pixamania.

    I assume when you say 'a client' you're not really running a business but are a guy that fixes/builds PCs for people. I say this as you wouldn't be dealing with Pixamania if you dealt with this on a regular basis, they are well known for the particular level of service they provide. If you are running a business then you have no consumer rights and this is not a consumer issue.

    EDIT: any return costs to Pixamania must be borne by them. Keep receipts and send them a copy for reimbursement.

    I do run a business it is pixminia pro that i am dealing with but never had this much trouble with them before.

    The issue is not one of the contract but how it's regulated. The Sale of Goods Acts, Consumer regs and unfair contract terms, in the main, do not apply. I'm not unsympathetic, but unfortunately your options are much more limited when purchasing in the course of a business.
