Bought a Samsung Tablet recently for my little one from the red fella in a few months. Has badgered all year the he wants one and just to be sure to be sure I don't get caught and can't get one I went and bought one. A week later he's changing his mind, doesn't want it now. Went back to Argos to return it only to be told we can't take refunds on that kind of item for fraud reasons. Apparently people shipping them from china and swapping them!!!!

Obviously it's still in the condition it was when I bought it, no seals broken etc etc

Surely the bloody thing is barcoded with there system and a quick scan would quickly tell that it was indeed the item that left their warehouse and not some warehouse in China!!!!

I now find myself snookered with something the child doesn't want:mad:

You have no right to a refund. This is a change of mind so the retailer does not have to offer a return.

They usually state on the receipt if an item is excluded from the 30 day warranty, does it say anything on it?

I know what my consumer rights are ,I wasn't demanding a refund, I simply explained the situation and thought maybe some common sense and discretion could be used

As said, it's a change of mind and doesn't qualify for a refund. If it's for someone still into the red fella then do what we used do - convince him he wants one.

The box has a barcode, but the item itself doesn't have a barcode, at least not one that would be in Argos' systems.

They're afraid that you bought an identical knockoff and swapped it, or you damaged it in some way that's not immediately visible.

As said, you have no recourse. Sell it on adverts?

Argos return policy is very clear when it comes to items like this

    http://www.argos.ie/static/StaticDisplay/includeName/ReturnsAndRefunds.htm

ˆIf a product is excluded from our 30-day money-back guarantee, it is clearly marked with a †

All of these items are marked clearly with this symbol, there's also posters explaining the return policy in ever store.

As stated before the box is unopened, all seals intact etc etc clearly obvious that it hasn't been opened/tampered with

There was a thread here recently where someone bought a perfectly sealed pouch of tobacco which contained a slice of bread. :P Unfortunately for you, scammers are very good at making packaging look untouched. The fact that this kind of scam happens means you get caught unable to refund a product, but if the retailer has a rule (and I can see why they have to), then that's it.

My kids know that mostly, once Santa knows you want something, then the 'order' cant be changed because his workshop are already making it. ;)

I would imagine the fraudsters stuff look perfect too.

Devices like these often have first time user setups too, you hear of people buying laptops which were used and having porn or stuff on them.

This is the usual reason for exemption by argos for laptops etc. Originally the no refund items were just shavers and personal care things. Then it became things people would "rent" from argos, like digital cameras, or video games.

That's it exactly. I hear with new Apple items that if the user has entered their Apple ID into the device then it has to go back to Apple to get the ID removed.

You can buy those circular stickers anywhere and there's plenty of machines around that heat shrink plastic film to stuff. Now I know the OP has a genuine reason for return, but Argos and the likes can't take the chance of losing large amounts of money to scams.

You have two options in my opinion.
You can try and sell in on ebay/done deal and make a bit of a loss.
Try and up sell it to him in the lead up to Christmas. Get relatives as well to say how good they are and he might change his mind again.

Argos Staff just follow procedures they use no discretion,
I bought a Philips Shaver for €31.98 (Bargain Alert from Nov 2012) , It became faulty and I had no receipt , I phoned Argos and they advised Bank Statement showing Debit Card transaction would suffice , I duly got same and brought shaver to local store , The current selling price is €118 and the lady did not believe I got if for €31.98 and had to check Transaction with head office as local records only go back 6 months , 2 mins later she confirmed all was in order and produced a spanking new shaver no further questions asked ,
