Can an NPO seek donations?

    As you know you can't register as a charity right off the bat, so for the first year, while operating as an non profit can you ask for donations? Or would that be illegal?

    Also, if a business were to donate can they still write that off at tax time or has that changed?

    I was looking at this a few years ago and an accountant friend told me that there is no legal obligation for charity registration in Ireland, well certainly there wasn't in 2009. There is a registration process with Revenue but that's to do with availing of tax relief schemes for donations and not a regulatory requirement; he said that many people do get them mixed up and with due reason but legally there was no onus to register with them.

    To answer your questions about offsetting of business donations you would be better off to ask on the Taxation forum. As regards the issue of donations, I don't see why it would be illegal.

    Charities Act 2009 provides for a regulator and a register of charities but it has never been commenced.
