Hi we are now unemployed and unable to pay our mortgage. Can any one give us advice on what to do? It was a mortgage we should never have being granted. I have heard recently people are now taking banks to court for mis selling a product? Can anyone help me. Thank you

Talk to MABS and your bank?

Why should it not have been granted to you?

Sorry to hear you lost your job

Contact your bank and MABs to discuss debt management.

If the mortgage was granted then you would have met the criteria at the time of application. Hindsight is a fabulous thing but it doesn't really allow you to walk away from your obligations.

If it so obvious it should never have been granted why did you take it?

well then you were very stupid applying for it in the first place. Hindsight is 20/20 you are still libel for the debt.

There was a lot of invented figures when people were applying for mortgages back in the boom, and a lot of people getting a level of loan they should never have, as you say you were.

There was definitely reckless lending by the banks, but unfortunately you signed on the dotted line to take on this debt and its yours. Not heard anything about banks being sued for reckless lending to be honest.

Best thing you can do as others have said is talk to your bank and MABS and try to work something out. You may get a debt reduction over time but if it is a worst case scenario then you may have to look at the recent personal insolvency legislation.

Goood luck with whatever route you take.

Your opening post is way to vague for anyone to give constructive feedback upon. If this is the extent of the further information you're going to give to assist folks trying to help you, then 1) you're not going to get an awful lot of help and 2) the thread will soon be closed.

    Wow!

I think you will be very disappointed with the end result of "taking action" against the bank. It's is great to see the victim mentality of the Irish is still flourishing away.

    An few honest questions OP:

    1. Did you even stop to think before taking out the mortgage?
    2. Did you honestly represent your financial situation when applying?
    3. Did you account for contingency if your financial situation changed for the worse?
These questions will all be asked of you. You were not forced to accept the loan, thus you have no case.

[Tongue-in-cheek]Of course on the plus side this being Ireland, you will be allowed live in your house indefinitely without paying[/Tongue-in-cheek]

    Amusing...

This all sounds a little easy, I would say there might be about 50,000 people out there who would like to know how you can sue the banks.

either the OP is a troll whos failing badly or is frighteningly clueless. Mind you at least somebody in the bank will get a good laugh at their attempt to sue. Its hard to have any sympathy for somebody like the OP when they don't have the maturity to even realize they are the cause of their own problems.

come back and give us a good laugh op after you have "sued" the bank.....
im sure 100% of people in mortgage arrears would say exactly the same thing, and i havent yet seen a stampede to sue every bank.
