    Heyo

    I just have a few questions about some law matters that I keep getting asked about by some friends.

    How longs does it take to sue somebody for money owed from day 1 being the day they go to the lawyer?

    And can someone sue you for something that hasn't happened yet? I mean start the legal proceedings before anything has occurred yet.

    I'm afraid this is a "how long is a piece of string question".

    Can you sue for something that hasn't happened yet? Depends, you can bring some actions before an event but suing for compensation, no.

    The law is far too complex to answer questions so basic, we would need all the information i'm afraid and if you gave it to us, we arent allowed give legal advice here anyway.

    Well then it depends on how much is owed because that will determine what court its in and generally the high court would be slower than the circuit or districts courts. It also depends on the method the lawyer uses to get the debts repaid, there can be a few ways depending on whether the money is a fixed sum and whether there is a defence to the debt or not. Far too many variables but those are some things to consider.

    I am assuming the small claims court as it is under 5 grand.

    Small claims only deal with cases under €2000 and don't deal with debts. You need to take a case in the District Court. The small claims procedure is exactly that if one is pedantic, it's not a court in of itself.

    If it's a business debt you can't use the small claims court. However there are lots of good debt collection agencies out there. Not sure if they take on personal debts.

    It will take a number of months. If it small enough money you will get a District Court date reasonably promptly. I assume that you have followed the solicitors letter route threatening proceedings etc.

    I was just wondering about it because I am leaving to work abroad soon and I need to know so that I can book time off roughly to come back.
