Bought a Stolen Iphone4s on Ebay

My fiancee wanted to get me an Iphone4s but couldnt afford to pay full price so she went to ebay and paid over £200 for a second hand Iphone4s.

The Iphone was meant to be network unlocked aswell.

The Iphone got delivered two weeks ago but I was away so I got round to using it last weekend and when I put my sim card in The phone didnt work and when herself went to get the phone unlocked she was told that the phone was stolen and its as good as a paperweight.

She got onto paypal and told the seller that the phone is stolen and has done an online check to prove that the phone is stolen and the seller's response was that they were unaware that the phone was reported stolen. And that they questioned why it had taken so long to complain.

The seller has suggested that if my fiancee wants a refund she has to return the phone along with the proof of details that the phone is stolen.

She's unsure wheather to return the phone.

    Any advice?

Normally a return is necessary, but I'm unsure whether this applies to stolen goods as it doesn't seem like an ideal solution. Open the dispute, and if you do have to return, ensure it's via a tracked method.

Don't return it until you have your money back. Opeb a PP claim. Ensure paypal fully understand that the seller has sold you a stolen phone, and forward all documents and screenshots proving this to them. Good luck.

As others have said, Paypal dispute now. I would also recommend that anyone buying a phone on ebay checks it out as soon as it arrives and delay buying one if you are not in a position to check when delivered
