personal injuries board

    Hi all, just wondering if anyone can help. Last year I fractured my heal after falling down a pothole nd I went to see a solicitor. He sent info on to the piab last July, I went to an independent specialist in October nd December I had to sign for permission for the specialist report to be released. I rang my solicitor 2 weeks ago to see where my claim is at now nd was told 'its with the board'. Does anyone know roughly how long more it should be please?

    Hey mrskell.... Legal forum is best for this but I can give you the answers you need.

    The start of the process in a nutshell. Claim is made (by you) and the respondent (person you feel is liable for injury is notified). They have up to 3 months to accept/not dispute liability. From that point the injuries board aim to have proposed settlement out within 9 months. Typical running time is circa 7/7 and a half months. Once figure is proposed the respondent has 21 days to accept/reject proposed settlement. You have 28 days. If both parties accept then thats it, order to pay is made and I believe they have 30 days to settle.

    If either party reject then there are other implications/considerations.

    Unfortunately a lesson you will learn when dealing with personal injury issues is patience.

    In rare cases the injuries board can extend that 9 months... I would speculate these are situations where there are ongoing symptoms or long term prognosis is not nailed down.
